Yr wyf heddiw wedi trafod gyda ein cyfieithwr – Michael Imperato sydd wedi cael cyfarfod gyda’r Bwrdd Legal Aid. Fel y tybiodd mai’r Bwrdd Legal Aid wedi troi lawr cais ein plant ar y rownd gyntaf o geisio am y cymhorthdal. I’r rhai ohonoch sydd wedi cael ffurflen “Application for Review” APP9 mae eisiau ichi arwyddo (fel y rhiant), rhoi’r dyddiad a enw llawn a dychwelyd y ffurflen at sylw Michael Imperato, Russel, Jones & Walker Landor Court, 51 Charles Street, Caerdydd. Y 2 rheswm mwyaf yr ydym wedi cael ein troi lawr yw yn gyntaf bod rhaid i ni ddangos yn fwy eglur bod yna effaith yn mynd i fod ar y gymuned o ran colli’r Ysgol gynradd. Ac yn ail fod y Bwrdd Legal aid yn gofyn pam nad all y rhieni ariannu’r gost o fynd ar achos i’r llys. O ran y pwynt cyntaf mae Michael Imperato wedi dweud ein bod am anghytuno gyda’r penderfyniad o beidio rhoi’r Legal Aid felly mae yna Fwrdd Apel yn cyfarfod yng Nghaerdydd ar brynhawn Mercher y 10ed o Fedi ble i egluro’r effaith ar y gymuned mae Michael yn gofyn am ryw 6 o bobl i ddod o siarad o flaen y Bwrdd Apel. Yr wyf wedi clustnodi prynhawn i fynd i Gaerdydd ble hoffem i eraill sydd yn ddigon hyderus i siarad i ddod hefyd.
O ran yr ail bwynt mae nawr rhaid i ni ddanfon ffurflenni Legal Aid newydd yn enw’r rhieni sydd yn credu ei bont yn gymwys am Legal Aid. Mae Michael wedi egluro i mi mae nid yn unig bobl sydd ar incwm bach sydd yn deilwng ond hefyd nifer o rieni sydd yn ennill yn weddol ond bod gyda nhw dipyn o daliadau yn mynd allan bob mis. Y ffactor mwyaf o fod yn gymwys yw’r “disposable Income” ble rhaid i bawb edrych ar faint o gostau morgais a chostau rhedeg tu a cadw plant sydd gan bawb wrth benderfynu lanw’r ffurflen. Mae Michael wedi danfon y ffurflenni Legal Aid newydd ymlaen ble mae eisiau cymaint a phosib i lanw nhw a danfon nol cyn gynted a phosib. Os oes cwestiynau gan unrhyw un rhowch alwad i mi ar 01239 831962 ble gobeithiwn gael y rhain yn nol cyn gynted a phosib. Yn ddelfrydol mae angen o leiaf 20 o rieni i ddanfon y ffurflenni yn nol i ddangos nad ydym yn medru ariannu costau yr achos llys.
Rhain imi bwysleisio bos y set olaf o ffurflenni yma YN HYNOD O BWYSIG I ACHUB YR YSGOL ble bydd y bwrdd Legal Aid yn
gweld nad yw’n bosib inni ariannu’r gost ein hyn ac yna ar y 10ed o Fedi gobeithiwn yn wir y bydd gennym benderfyniad positif ar gyfer achub yr Ysgol. Fe fydd y bobl sydd yn llawn a danfon y ffurflenni yn ol wedi cyflawni camp hynod o bwysig yn yr ymgyrch i gadw’r Ysgol ar agor felly rhaid imi bwysleisio ei fod yn angenrheidiol ichi gymeryd yr amser i lanw rhain ai danfon yn nol cyn gynted a phosib. Danfonwch nhw yn ol at Michael Imperato ar y cyfeiriad uchod. Dear Parents/Friends
I have today had a telephone conversation with our legal representative – Michael Imperato who has been in discussions with the Legal Aid Board. He informs us that as he thought the Legal Aid Board has turned down the Children’s case for legal Aid. Those who have had an Application for Review form APP9 please sign, date and print your name (guardians name) on the bottom and return to Michael Imperato at Russel, Jones & Walker Landor Court, 51 Charles Street, Cardiff. CF10 2GD
There are 2 main issues which are currently not in our favour with Legal Aid, these are, firstly, the evidence for the wider effect on the community of closing the school and secondly, the issue of why could it not be possible that certain funds could be raised to fight the case without the need for legal aid i.e. why can’t the parents raise the cash. It has not come as a major shock to Michael Imperato that we have been turned down at this first stage where he now wishes to make an appeal to the Appeal Board who will meet in Cardiff on the 10th of September. In order to address point one above, Michael Imperato has asked if some parents are prepared to come and speak infront of the Legal Aid Appeal panel on the afternoon of Wednesday the 10th of September at Cardiff. He mentions possibly a maximum of 6 people who are willing to be vocal in terms of the negative effect on the community. I am prepared to take an afternoon off where if anyone outspoken can also come along then that would be good.
The second point relates to the fact that now we must put in legal aid application forms in the name of parents. Michael Imperato points out that it is not only lower earning parents that are eligible for legal aid but also most middle earning families where parents have to show that their disposable income is low, i.e. even though a couple might be earning well but when taking out mortgage costs and monthly/annual household and children costs the actual monthly disposal income is not that great. Therefore Michael has forward more Legal Aid Forms for parents to fill in, where anyone who believes they could fit into the category please return the forms to him as soon as possible. If you need any help please give me a call on 01239 831962 and hopefully post them as soon as possible. Ideally we need at least 20 sets of parents to fill in the forms to show that we could not fund legal costs.
I must stress that this final set of forms are HIGHLY IMPORTANT FOR US TO SAVE THE SCHOOL where the Legal Aid Board Review will see that funding the whole case ourselves is impossible and the 10th of September will truly be a landmark date for us to retain the school. Those who can send back these forms will play a vital role in the campaign so please give the time to fill them in as soon as possible. Send the forms back to Michael Imperato at the above address.
